Uncontested Divorce and Mediation - When They May Work For You

An uncontested divorce may proceed with or without divorce mediation.  Generally, if the parties are amicable and are undecided on the terms of their divorce, divorce mediation may be a choice that they wish to pursue prior to retaining an attorney to file and put through their uncontested divorce.  If, however, the parties are generally in agreement on their terms of divorce, then mediation may not be necessary prior to retaining a divorce lawyer or divorce attorney.

If the two parties have agreed upon the terms of their divorce, we may draft a property or matrimonial settlement agreement, which may include terms regarding child custody, child support, alimony, relocation of the child or removal of the child from the State of New Jersey, equitable distribution of assets, including the marital residence, cars, retirement accounts, 401ks, annuities, IRAs, pensions, stock portfolios and other assets.  Upon the parties agreeing with their terms of an agreement, the hard part is over, however, procedurally, there is more to do with the Court to allow the divorce to be put through and filed with the Court.

In the case where the parties are not agreed upon their terms for divorce, but are amicable, and wish to go to a mediator to settle their terms, a Memorandum of Understanding is prepared by the mediator encompassing all the terms of the divorce. The MOU is an agreement to agree and must then be converted to a Property Settlement Agreement or Matrimonial Settlement Agreement.  Our offices will convert the MOU, file the complaint for divorce, serve the complaint and file any other documents necessary to put through the divorce and set up a default or uncontested divorce hearing where the divorce is put through and the terms of the agreement are incorporated in any Final Judgment of Divorce by the Court.
