New Jersey Divorce Recognized in India - Willful Desertion 

New Jersey Family Courts recognize the cause of action for divorce of "willful desertion" or "willful and continued desertion" for greater than 12 months.  In India, the Indian Courts will generally recognize a New Jersey divorce or foreign divorce if the cause of action is one that is recognized in India.  An Indian divorce cause of action exists for desertion or abandonment for greater than 2 years.  So, if a party may obtain a New Jersey divorce for desertion, generally that divorce will be upheld in an Indian Court and the New Jersey divorce will be recognized as the divorce of the parties in India.
